1. Introduction
This Privacy Policy explains how AccessMark ("AccessMark," "we," "us," or "our") collects, uses, and protects your information when you visit accessmark.io or use our services. AccessMark is operated by Socialytica AI LLC PR, the compliance services execution arm of Intelligence Quanta, LLC — a Puerto Rico Act 60 company.
By using this site or submitting any form, you consent to the practices described here.
2. Information We Collect
2.1 Information you provide directly
When you submit a contact form, sample scan request, or other inquiry, we collect:
- Name and email address
- Organization name and organization type
- Website URL you enter into the sample scan tool
- Free-text message content you voluntarily provide
- Language preference (English or Spanish) and submission timestamp
2.2 Information collected automatically
Our web hosting provider may log standard technical information including IP address, browser type, device type, referring URL, and pages visited, for security and operational purposes. We do not use third-party analytics or advertising trackers.
2.3 Browser storage (localStorage)
We store two small values in your browser's localStorage to improve your experience:
- am-lang — your selected language ("en" or "es")
- am-theme — your selected visual theme ("light" or "dark")
These values stay on your device. They are not transmitted to our servers and are not used for tracking. You can clear them at any time via your browser settings.
3. How We Use Your Information
We use the information you provide to:
- Respond to your inquiry or compliance request
- Deliver the simulated sample scan report
- Prepare and deliver AccessMark audits, remediation, certification, and monitoring services
- Communicate with you about your organization's compliance pathway
- Comply with legal obligations, protect our rights, and prevent fraud or abuse
We do not sell, rent, or trade your personal information. We do not use your data for advertising.
4. Third-Party Processors
We rely on a small number of vetted vendors to operate this site and deliver services:
- Web3Forms — processes form submissions (contact form and sample scan requests) and relays them to us via email. Form data is transmitted to Web3Forms' infrastructure. See web3forms.com for their privacy terms.
- hCaptcha — provides spam and bot protection on forms (loaded via Web3Forms). hCaptcha processes limited technical signals to distinguish human from automated traffic.
- Hostinger — provides web hosting infrastructure. Hostinger may log standard server-access data.
- Google Workspace — hosts our compliance@accessmark.io email. Messages you send to that address are stored and processed by Google.
Each of these processors is contractually or through their published terms obligated to handle data responsibly. We do not share your information with any other third party except when required by law.
5. Data Retention
We retain form submissions and email correspondence for as long as necessary to respond to your inquiry and deliver contracted services, and thereafter for reasonable business-record and legal-compliance purposes. You may request deletion at any time (see Section 8).
6. Security
We take reasonable technical and administrative measures to protect the information you provide, including TLS encryption in transit. However, no internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.
7. Jurisdictions and Applicable Law
7.1 Puerto Rico and United States
AccessMark operates from Puerto Rico (a U.S. jurisdiction) and follows applicable Commonwealth of Puerto Rico and U.S. federal privacy standards. If you are a U.S. resident, your data is handled in accordance with applicable state and federal privacy laws.
7.2 European Economic Area / United Kingdom (GDPR)
If you are located in the EEA or UK, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR. The lawful bases on which we process your personal data include:
- Your consent when you submit a form
- Performance of a contract when you engage AccessMark's services
- Our legitimate interests in responding to inquiries and operating our business
- Compliance with legal obligations
Data transferred outside the EEA/UK is protected through appropriate safeguards as required by GDPR.
8. Your Rights
Regardless of your jurisdiction, you have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your personal information
- Object to or restrict certain processing
- Request a portable copy of information you provided
- Withdraw consent at any time (where processing is based on consent)
To exercise any of these rights, email compliance@accessmark.io. We will respond within a reasonable time frame (and within legally required deadlines, where applicable).
9. Children's Privacy
AccessMark's services are intended for organizations and their representatives. We do not knowingly collect information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.
10. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by an updated date at the top of this page. Continued use of the site after changes constitutes acceptance of the revised policy.
